I.          INTRODUCTION

Pulte Home Corporation, a Michigan corporation, is the Declarant under the Declaration and the developer of Grand Dominion by Del Webb.  Del Webb is a marketing brand of declarant (“Del Webb”).

Grand Dominion by Del Webb is an active adult community designed to respect the visual character of its site, minimize environmental impacts and maximize water and energy conservation principles.  In order to preserve and enhance these principles, these Design Guidelines are established to maintain certain standards by which the community may grow and develop.

The Design Guidelines provide an overall framework to allow the community to develop and progress in an orderly, cohesive and attractive manner, implementing planning concepts and philosophy which are required by regulatory agencies and desirable to residents.  The Design Guidelines include minimum standards for the design, size, location, style, structure, materials, color, and mode of architecture, mode of landscaping and relevant criteria for the construction or addition of improvements of any nature.  They also establish a process for judicious review of proposed new developments and changes within the Community.

The Design Guidelines have been adopted by the Board of Directors of the  Grand Dominion by Del Webb Community Association (the “Community Association”) pursuant to the Grand Dominion by Del Webb Declaration of Covenants, Conditions, Restrictions, Assessments, Liens, and Easements, which have been recorded with the    Lake County Recorders’ Office (the “Declaration”).  The Design Guidelines will be enforced by Del Webb during the Development Period as defined in the Declaration, and by the Modifications Committee established under Article IX of the Declaration after the end of the Development Period.  The Modifications Committee also may enforce the Design Guidelines during the Development Period to the extent these duties may be delegated by Del Webb.  For the purposes of this document, all applications for approval are assumed to be made to, and written approval issued by, Del Webb, although in some circumstances the authority to review and approve certain changes may be delegated to the Modifications Committee subject only to Del Webb’s right to review and withhold a particular approval.  The term “Modifications Committee” is used in this document to mean either Del Webb or, if the review has been delegated or the Development Period has ended, the Modifications Committee.

To the extent that any government ordinance, building code or regulation requires a more restrictive standard than that found in these Design Guidelines or the Declaration, the government standards shall prevail.  To the extent that the local ordinance is less restrictive than these Design Guidelines, and any standard contained therein, or the Declaration, these Design Guidelines and the Declaration shall prevail.

Homeowners are responsible for all cleanup of any improvement project.  All debris, sod, soil, etc. shall be removed from the lot and hauled to the proper waste sites off site.  No dumping is permitted within Grand Dominion.  If the project causes damage to any neighboring property, public or private, the homeowner is responsible for any necessary repairs. 


II.        RESIDENTIAL DESIGN GUIDELINES

A.                Architectural Character

1.                  Minimum construction requirements are set by current building code as enforced by the Village of Mundelein (847) 949-3200.

2.                  No exterior alteration or renovation shall be allowed on any single-family home unless prior application and written approval has been received from the Modifications Committee.

3.                  No work shall commence on any exterior additions or changes until two (2) Applications of Change and Compliance Form Architectural Modification Application Forms, and detailed plans, material list, and plat of survey have been submitted and approved by the Modifications Committee.

4.                  The architectural design of any and all additions, alterations, and renovations to the exterior of any existing single-family home shall strictly conform to the design of the original home in style, detailing, materials, and color.

5.                  The height of any addition to an existing single-family home shall not be higher than the original ridge-line and the proposed eave line must be at the same height of the existing eave-line.  No alterations or improvements shall be made which provide a roof pitch that varies from the roof originally constructed.

6.                  All structural (i.e., room additions) additions to homes shall be built within the building setback lines originally established for Grand Dominion by Del Webb or as modified by Del Webb with the requisite approval of the Village of Mundelein, regardless of any more lenient requirements of any local governmental authority.  These building setbacks are set forth in Appendix “A”.

7.                  All materials used in maintenance, repair, additions and alterations shall match those used by Del Webb as to color, composition, type, and method of attachment.  The Modifications Committee may allow substitute materials if such materials are deemed by the Modifications Committee in its sole discretion to be compatible with the theme of the community.

8.                  All additions, alterations or renovations that are attached to any dwelling unit may void applicable warranties.  It will be the homeowner’s responsibility to pay for any damages caused in the completions of any addition, alteration or renovation.

9.                  No additions, alterations or renovations shall be permitted if it is determined to have a material by the association if the Modification Committee has determined it has an adverse impact upon neighboring properties and/or the community.

            B.        Drainage Criteria and Guidelines

1.      When any additions, alterations, or renovations are performed to an existing single-family home, the established lot drainage must be restored to the original flow pattern.

2.      Any homeowner or resident who changes the existing grading or drainage shall be liable for all costs and expenses of repairing such chances changes, or any costs, liabilities, damages or causes of action arising out of such changes.

3.      All roofs and sump pump ejector lines shall drain to the ground solely within the deeded lot area and may not be discharged closer than five feet (5’) of any neighboring property.  Any project, including sump pump hoses and down spouts, may not materially increase the drainage of storm water onto adjacent property.  Drain lines, which direct roof drainage or sump pump water, must be approved by the Modifications Committee and will comply with the following standards:

a.       A drain line plan with pipe sizes, discharge locations, emitters, and existing drainage patterns must be submitted on a plot plan of the property to the Modifications Committee for consideration.
b.      No discharges of storm water may be closer than five feet (5’) of any neighboring property.
c.       Air gaps must be provided between downspouts and sump pump ejector lines and drain line extensions.
d.      Drain line extensions may not discharge water directly perpendicular to a neighboring property or an existing drainage flow-line.  Drain line alignments shall be set so that discharge water flows in the same basic direction as existing flow-lines on the lot.  Emitters, water disbursement, and/or erosion control measures must be provided to eliminate erosion of the soil on the lot.
e.       Roof drain downspouts, sump pump ejector lines, or any other surface runoff along with groundwater shall not be connected directly or indirectly to any public sanitary sewer system.
f.       Downspout extensions must be buried a minimum of 6” deep.
g.      Grate covers are to be used. Pop ups should not be used and installation must be at grade level.  Moved to page 23 (Gutters, Downspouts and Extensions)


C.       

Solar Energy/Alternative Energy

           

            1.   All solar energy/alternative energy

projects must meet all local, state, and federal requirements.  All permits must be copied and included with the application.

            2.   All solar photovoltaic (PV) systems must be designed and installed by a professional licensed contractor. 

The modification application must be accompanied by a report
from a licensed architect or engineer certifying that the roof structure is capable ofsupporting the installation and a plan that is “to scale” from the licensed contractor who will be installing the system with material and/or manufacturer’s description of system, photos/pictures of system and color.

 

            3.  

Installation of panels is to be flush mounted and restricted to a maximum height of
2(two) foot above the existing roof and must be parallel to the existing roof line once installed.


            4.   Solar panel collector units must be roof mounted and aes

thetically comparable in color with the surrounding roof.  Any component of the Solar PV system must integrate into the design of the home.  Freestanding
collector units are not allowed. 

III.       PRIVATE AREA LANDSCAPING

            A.        Private Area Defined

1.      The Private Area of each lot is defined as the area between the side setback lines, behind the twenty foot (20’) front setback line and in front of the twenty foot (20’) rear setback line; as such setbacks are described in Appendix “A” and are shown on the plot plan of each lot.  Private Areas also includes all portions of the lot within three feet (3’) of the front service walk as originally installed by Del Webb, regardless of whether these areas are within the setback boundaries.  On lots where the rear-most foundation wall of the home as originally constructed by Del Webb is less than twelve feet (12’) from the rear setback line, the rear line of the Private Area will be a line twelve feet (12’) from and running parallel to such rear most original foundation wall.  Please refer to Appendix “F” for an illustration.

            B.        Homeowner Landscape Responsibilities

1.      To preserve attractive view corridors and promote efficient landscape maintenance, no installation of landscape, hardscape materials or other improvements by homeowners shall commence without prior approval from the Modifications Committee.

a.       A minimum 2’, maximum 3’ foundation mulch strip must be maintained around the perimeter of home, and may not be eliminated.
b.      Existing side and rear foundation mulch beds may not exceed three feet (3’) from the foundation.
c.       Plantings must be no more than one foot (1’) from the side or rear foundation wall of the home.
d.      Patio plantings, excluding vegetables (see p. 6) are permitted up to three feet (3’) from the patio.
e.       Planting beds installed by Del Webb can be expanded as follows:  one foot (1’) diameter can be added to beds.  The tree rings can be expanded to allow for growth of a planted tree.  Both of the above items require prior approval before implementation. The Modifications Committee, in its sole discretion, may consider the following criteria when reviewing a request: (i) the impact the improvements will have on views, both on and off the subject lot; (ii) the impact the improvements will have for purposes of future maintenance of the areas affected by said improvements; (iii) the impact the improvements will have on landscape maintenance costs to the Community Association; and (iv) whether the improvements will enhance the overall appearance of the community.  The Modifications Committee shall have the express right to specify the location of any such improvements proposed to be located in side yards that face a street and on the pie-shaped lots.

2.      If planting areas are added to a homeowner’s lot by a homeowner, or any modification of existing beds is made by the homeowner, the existing and modified areas will be a part of the routine maintenance performed by the association, unless the owner installs a red landscape flag.  This will identify that the owner is maintaining that area.  Homeowner maintenance shall include, (but not be limited to):

a.   Re-mulching at least every two years by June 30th, with mulch consistent with that originally installed by the Community Association (see appendix D section A).  Mulching must be installed in harmony with mulching by the Community Association.
b.   Replacement of all dead plant material.
c.   All pruning and shaping of material

that is not covered by the association.
d.   Applications of fertilizer in planted areas to include side beds, rear beds, and kidney and tree ring.  The association provides
two
fertilizer applications.  One
application
is done in spring and one in fall.  Additional applications are the responsibility of the owner.   Please refer to P&G Reference Guide.
e.   Replacement of original plantings after warranty expiration are the home owner’s responsibility.  If replaced with material of identical species, no permission is required.
f.    Weed control over and above what is provided by the association.

3.      Prohibited plantings for Grand Dominion by Del Webb were selected after consideration of many factors.  A list of the prohibited plantings, accompanied with minimum size information, is set forth in Appendix “E”.

4.      Individual plantings of annuals and other plantings which are seasonal in nature, and are planted within the original planting bed installed by Del Webb and do not exceed thirty six inches (36”) in height, do not require the approval of the Modifications Committee.  No such plants exceeding thirty-six inches (36”) in height shall be permitted anywhere on the lot
with the exception of ornamental grasses
.  Any areas that are planted with annuals and seasonal plants must be maintained by the homeowner in accordance with the maintenance standards comprising the Community-Wide Standard.  The Modifications Committee reserves the right to limit the number of annual and seasonal plants.

5.      If a homeowner chooses to plant trees, shrubs, groundcovers, perennials, grasses and vines within the original planting beds installed by Del Webb the homeowner shall take into account future growth.  The planting should be at a reasonable distance from foundation walls and will be maintained in accordance with maintenance standards.

6.      The ground surfaces of all portions of the lot outside the planting beds shall be covered with turf.  Any
overseeding

over seeding
shall be with Kentucky Blue Grass.

7.      No decorative rock shall be permitted as ground cover.  The only exception for decorative rock is in planting beds not to exceed two feet (2’) four (4) square feet wide at downspout.  Ground cover or inert material shall not be used to spell out names, nicknames, names of states, city athletic teams, slogans, emblems, geometric patterns or any other communication.  Stones, rocks and boulders shall not be used as bed-edging material and are not permitted on turf areas.  The Modifications Committee reserves the right to limit the number of stones, rocks and boulders used as decoration in a landscape.  Rubber mulch or plastic sheeting is not permitted.  Please reference Appendix “D”.

8.      Homeowners are responsible for all clean up of the project.  All debris, sod, soil, etc. is to be removed and hauled to the proper waste sites, outside of community.  Dumping waste in common areas or in any other area of the community is prohibited.

9.      The project shall not cause any damage to a neighboring property or common area. In the event of such damage, the homeowner is responsible for all repairs and restoration.

10. After expiration of Developer’s warranty:

      a.   All dead material must be removed in a timely manner
      b.   Dead material must be replaced with like plantings to preserve the overall landscape design.  Should you choose to not replace with identical species an application must be submitted for review and approval.

         C.                 Vegetable Gardens

1.      Vegetable gardens are only permitted within rear yard area and shall comply with the following:

a.       All vegetable gardens must be kept to the rear 2’ mulch strip of the home.
b.      When planting in the existing rear mulch bed along the foundation wall, plantings may not exceed

three foot (3’) area.  Vegetable area must be kept maintained at all times.
c.       Plants shall not exceed 36” in height.
d.      Usage of large vegetable pots on patio or deck shall not exceed four (4) total.
e.       Vegetable plantings are not permitted at patio perimeter.
f.       Extermination of rodents and other pests attracted to vegetables is the sole responsibility of the owner.
g.      Any damage caused by the rodents or pests to residential lot or common areas will be the sole responsibility of the owner.  The Association may elect to have a contractor make the necessary repairs and charge back to the owner.

            D.        Additional Trees

1.      Tree(s) in addition to those within the kidney or circular rear yard mulch beds are permitted under the following parameters:

a.       Tree size (height) will be limited to moderate size (50 feet) at maturity.  Width at maturity no more than 25’.
b.      Location of the planting will be subject to review by the committee based upon detailed location shown on Plat of Survey submitted with application for change form showing measured distance from rear foundation, wall, deck or patio.  Trees must be at least five to no more than ten (5’-10’) feet from foundation wall, patio or deck within property lot line.  The trees may not encroach into the utility or swale easements.
c.       Homeowners are responsible for care and maintenance.
d.      Approval will be based on lot size.
e.       Any additional trees must be planted within a mulch ring with a 3’ minimum diameter.

            E.         Landscape plan requirements for permits

1.      The Landscape Plans submitted by the homeowner to the Modifications Committee shall include:

a.       A list outlining plants to be used.  The common plant name, variety, quantity, size and spacing must be submitted.
b.      Proposed plantings with location of trees, shrubs, mulch and grass/ground cover all clearly labeled and shown in mature size.
c.       Plant enhancements shall be consistent with what is being used in the community.


IV.       VIEW CORRIDOR LANDSCAPING

A.                View Corridor Defined

1.      Each lot has a ‘view corridor’, which is the area between the rear lot line and the ‘private area’ immediately behind the rear of the residence.  As a “view corridor” landscape restrictions are imposed to maintain an attractive view free of tree clusters, fences and other deterrents.

            B.        Kidney and Circular Mulch Areas

1.      Del Webb has dedicated two (2) mulch areas within the view corridor for landscaping desired by the owner and as approved by the Modifications Committee.

a.       One mulch area is a five (5) foot circular area and the other is a kidney shaped area approximately sixteen (16) feet in length and of variable width.  Sizes do vary based on lot size.
b.      An owner has the option should they choose not to plant in the kidney or tree mulch bed.  They should install sod with Kentucky Blue Grass consistent with what is currently used in the community.  Approval is required by the Modifications Committee.

V.        COMMUNITY ASSOCIATION LANDSCAPING RESPONSIBILITIES & MAINTENANCE

Certain areas have been designated as open space, wetland or preserve on neighborhood plats and shall be maintained as required by regulatory authorities and as described in specific permit conditions and in the Declaration.  No homeowner or resident may mow, fertilize, apply pesticides to, maintain, alter or modify any area not owned by the homeowner, including areas set aside as open space, wetland or preserve.  No homeowner shall cut flowers or growth from these areas and will be subject to fines. when caught.

A.                Del Webb installs on each residential lot a landscape package.  The Community Association will provide limited lawn and landscape maintenance to the lot.  Homeowners are prohibited from applying chemicals, performing any lawn or landscape maintenance except for improvements made by homeowners.

B.        Landscaping maintenance and replacement shall be in accordance with the maintenance standards comprising the Community-Wide Standard.

C.        The Community Association will provide mowing and limited landscape maintenance within the residential lots.  The Community-Wide Standard for landscape maintenance includes the measures described in the following subparagraphs: 

1.   Mowing of turf will be conducted at least approximately once every seven (7) days, weather permitting.  Walks, driveways and patios will be swept or blown free of grass clippings and also kept free of weeds. Walkways and planting beds are to be kept edged to maintain a crisp appearance.  Tree rings will be edged and kept free of weeds, either manually or through appropriate post-emergent herbicides. 

2.   Fertilizing and aeration will be conducted as necessary to keep the quality and color of turf reasonably consistent with that of the common areas.  Turf will be treated once in the spring and once in late summer to control broadleaf weeds.  Watering of residential lots is the responsibility and required of the homeowner.

3.   Spring and fall cleanup will occur annually – see portal for details.

4.   Common area trees will be spot-pruned during the growing season to promote shaping and thinning and to remove branches that interfere with nearby improvements or pedestrian traffic.  During the dormant season, trees will be pruned to remove dead, damaged or crossing branches and to develop the natural form of the tree.  Dead or diseased trees will be removed or trimmed as soon as discovered, after taking appropriate measures to protect against the spread of disease, and will be replaced as needed to maintain the appearance of the community.  A homeowner may not cut down or remove any tree in the association’s common areas.

5.   Original trees and shrubs within the common areas will be replaced in the spring and fall if the warranty applies.

6.      A group of neighbors may petition to add landscaping to common areas.  Such additions cannot add to the Association maintenance of the area and all costs must be borne by the requesting group after Developer dedication.


VI.       PRIVATE AREA, STRUCTURES AND HARDSCAPES

Item III, A “Private Landscaping” defined the very minimum private area to be twelve (12) feet. However, some residences have in excess of this distance. All residence additions, pergolas, decks and patios shall be installed within the private areas. The Modifications Committee reserves the right to limit structure, size and location.
           
            A.        Pergolas, Trellises, and Arbors

1.      All pergolas, trellises and arbors must be constructed of vinyl, aluminum, vinyl-coated, cedar or pressure treated materials. Pergolas constructed on an existing patio or in Private Area of yard must be painted or finished white or natural. Pergolas constructed on existing decks must remain consistent to existing finish color.

onstruction drawings, elevations, and details must be submitted to the Modifications Committee for all pergola, trellis, and arbor applications.

2.      All pergolas, trellises and arbors must be constructed within the rear Private Area of the lot.  Pergolas may not exceed forty percent (40%) of the width of the home or be a maximum width of eighteen feet (18’), whichever is less. 

3.      Pergolas and shade structures must be structurally sound and anchored in accordance with local codes.  Knee bracing or cross-bracing shall not be utilized on any side of the structure.  When framed, the highest point of a pergola may not exceed the eave height of the home.  Please see Appendix “C” for an example of a typical pergola.

4.      One (1) or more No more than three (3) trellises may be installed to shield a patio or deck if approved by the Modifications Committee.  Attaching a trellis to your home may void applicable warranties from Del Webb.  Trellises used to screen decks or patios that have a height extending to the eaves of the home may have a maximum width of no greater than twelve feet (12’) may have a height not to exceed 8’ with a maximum of 12’ may have a maximum height of 8’ and maximum width of 12’.  Multiple trellises must be separated by a gap at a minimum distance equal to the middle of trellis.  Applications for trellises that do not extend to the eave height of the home shall be reviewed on a case-by case basis to determine allowable width and configuration.  Each trellis must support plants or vine growth and thereafter maintained with plants or vines growing on it, and remain plumb, level, and structurally sound.  The intent of these Design Guidelines is that trellises may not be used as substitutes for fences.  Please see Appendix “C” for an example of a typical trellis.

5.      Anchoring posts in lawn area must be surrounded by a 1’-3’ diameter mulch bed.

6.      One (1) arbor may be installed only if structurally sound and in accordance with local building codes.  Arbors may not be attached to the home nor exceed eight feet (8’) in height, four feet (4’) in width, and four feet (4’) in depth.  The arbor must support plant or vine growth and thereafter be maintained with plants or vines growing on it.  As all arbors are different, approval will rest with the Modifications Committee.  Please see Appendix “C” for an example of a typical arbor.

B.        Decks and Patios  

1.   Decks and patios shall be designed in harmony with the architecture of the home. All handrails, rim joints, stringers, spindles and any other vertical member shall be constructed of cedar, pressure treated lumber or composite materials. Color is to remain natural, white, or the color of the trim of house. Decking, flooring, and understructure shall be constructed out of cedar, pressure treated lumber, or composite materials. Construction of decks and patios that conflict with the drainage pattern established for the lot will not be allowed.

2. Deck extensions to Del Webb decks must be treated lumber, cedar, or composite materials. However, materials must be consistent throughout and must comply with the natural deck color. No extension or modification shall be approved if it is determined to have a material adverse impact upon neighboring properties and/or the community. The size of decks and patios shall be determined by the available space per lot and within the Private Area. The Modifications Committee reserves the right to limit the size and location of enlarged decks and patios. All newly constructed areas that cover existing sod will need to have sod removed to eliminate need for landscape maintenance. Sub-surface must provide for either mulch or hard surface.
     

3.   Deck rails cannot exceed forty-eight inches (48”) in height, from decking, and must be constructed to match the material and color of the existing decking either natural or white.  Other options may be considered and presented to the Modifications committee for approval.

            4.   Deck rails may extend more than twelve feet (12’) from the existing home, but only to surround a deck or patio.  It must be constructed in such a manner as to meet local building codes.  All rails must be constructed with a smooth top so as to be able to serve as a handrail.

            4.   Foundation types for decks will vary dependant on whether the deck is free standing or tied to the residence. Coordination with the Village of Mundelein is required.

            5.   Anchoring posts in lawn area must be surrounded by a 1’-3’ diameter mulch bed.

            6.   Patio paver type, color and size shall be included with the paver brochure for the Modifications Committee approval.

            7.   A coating may be added to patio surface, subject to Committee review.  To avoid damage to coating, it is recommended a 1’ to 3’ mulch bed

be installed around such coated patio area.

            8.  
Final

construction drawings are required for decks and patios and shall denote location and physical size of either system. All pertinent information shall also be included. Modifications Committee approval is required for changes to all decks and patios.

                        9.   Outdoor surfaces may not be carpeted or permanently attached.

                        10. Screening is not permitted unless it meets the room criteria additions and  
                              screened in structures guidelines.


C.        Fences, Walls and Invisible (Pet Restraint) Fencing

1.      Yard fences of any type are not allowed unless provided by Del Webb.

2.      All Walls may not exceed forty-eight inches (48”)
maximum
in height. All Walls adjacent to a patio wall must generally run parallel and perpendicular to the primary surface and may have 90 degree corners or may have a gentle curved shape.  There must be a minimum of one 36” opening.  Permanent gates are not permitted.  On sloping terrain, the top and bottom of all wall sections shall be level, and the wall segments must be stepped down in equal increments not to exceed eight inches (8”) each to adjust to the changing grade.
3.      No wall will be constructed that is in conflict with the drainage pattern as established for the lot.  All Walls must be of approved masonry design, constructed of brick, cultured or natural stone, or masonry block.

nade alignments must be submitted for approval prior to construction in accordance with the review procedures.  It is the intent of these provisions to preserve view corridors and access for efficient maintenance, and to protect drainage patterns established with the original lot design.
5.      Invisible fencing may be used for the restraint of pets within the private and common lot areas.  All Wiring must be buried no less than six inches (6”).   No alterations of the yard grade shall be permitted from the installation of such system.  Neither Del Webb nor the Community Association shall be responsible for repair to any system that is damaged by normal maintenance of the yard by the Community Association or their designee. Regardless of the method of restraint used, pet owners are responsible for assuring that their pets do not run free.  Pet owners are liable for any damage to persons or property caused by their pets.

onstruction drawings are required for all walls and will denote the physical size and location of either system and wall elevations if of variable height. Seat walls are permitted.
7.      No temporary or permanent confinement on/or under decks or patios for pets is permitted.
                                                              i.      Pets should be attended at all times and remain within their owner’s property.
                                                            ii.      No dog runs are allowed.
                                                          iii.      Pets when being walked must be under control and leashed.
                                                          iv.      Owner must pick up dog feces immediately.

            D.        Room Additions
& Screened in Structures

1.      Room additions must be constructed within the building set back of the lot and shall not project beyond the side walls of the residence.

2.      Criteria noted in II, A “Architectural Character” must be adhered to on all additions.

3.      Roof lines shall be compatible to the existing residence and gables utilized. Shed roofs or flat roofs are not permitted.   

4.      Attachment of room addition to the existing residence may void applicable warranties.

5.      The arrangement proportioning and design of windows and doors shall comply with the existing including type, size and style. Window placement shall not compromise neighbor’s privacy.

Barbecues
Barbecues Grilling

1.   Built-in and portable barbecue barbeque units shall be for cooking only and must be located within the rear yard Private Area. Built-in barbecues barbeques must be designed to be consistent with the style of the home.  Location must be carefully planned to minimize smoke, damage or odors affecting neighboring properties.  All outdoor barbecues barbeques must be natural gas, charcoal or propane gas.

2.   Built-in barbeque barbecue construction drawings, color and material list shall be submitted for the Modifications Committee approval.



F.         Planter Boxes

1.      Planter boxes are permitted. They must be maintained during seasonal growing period with seasonal planting material or be removed.  Plastic or artificial planting material is not permitted anywhere on a lot.

G.        Benches and Planters

1.   Landscape architectural features may include such items as benches, planters, yard lights, etc. as an integral part of a landscape architectural design.  Drawings must be provided to the Modifications Committee, which clearly show the location, size, color, and materials planned for these features.  In addition, a photograph of the home and the relationship of the feature to the existing or proposed landscape must accompany the submittal.  Landscape architectural features will be located only in the planting beds and within the private area or in the view corridor.

H.        Equipment Screening

1.      Any screening of ground-mounted equipment (HVAC) shall be of live material, located a minimum of two feet (2) from the equipment to allow for adequate air circulation around the equipment.  In no event shall plastic sheeting be used for screening.

2.      All additional ground mounted mechanical equipment must be screened from street view and neighboring property by a structure no higher than one foot (1) above the equipment to be screened or by plant material of adequate density to accomplish the same result: provided, however in no event shall a screening structure or planting exceed four feet (4) in height. With the exception of approved power vents for attic fans and solar tubes and approved lighting protection devices, roof mounted and window mounted equipment (including mechanical and air conditioning equipment) will not be allowed.

I.          Statues & Artifacts

objects and/or
components such as statues, water featureseach under four feet high (48”), may be installed on the lot withinthe mulched or paved concrete areas of a property. Up to five (5) of these may be installedin the front of the home which includes those affixed to the front facade or homes on a corner lot or on the side façade of homes on a corner lot.  Decorative objects and water features must be intended by their manufacturer for exterior, garden use.and artifacts shall be limited in height to four feet (4’) above the natural grade of the lot.  Statues and artifacts will be allowed only in the Private Area of the lot if they meet the following criteria:

·         Seasonal statues, artifacts, lighting and other decorative landscaping items will be allowed within thirty (30) days prior to, and thirty (30) days after the Christmas any national, legal or religious holiday season, which period may be extended by the Modifications Committee, in its sole discretion, due to extreme weather conditions.  During such extended periods, lighting may not be illuminated. All other holiday décor will be permitted two (2) weeks prior and two (2) weeks after the holiday.

Painted objects

must be maintained not to reflect chipping or deterioration.

·         Statues and artifacts will be allowed

.   The Modifications Committee reserves the right to require screening of statues and artifacts from neighboring lots or the street.

J.          Fountains, Water Features and Bird Baths & Feeders

1.      Fountains and, water features or and bird baths shall be limited in height to four feet (4’) above the natural grade of the lot.  Any fountain shall be of natural material, color and design, each of which is compatible with the overall architectural theme of Grand Dominion by Del Webb.  Fountains and water features shall be permitted.  Design of these features should discourage creation of stagnant pools of water.  No more than a total of two (2) features per lot.

2.      No more than 2 bird feeders permitted per lot.  Bird feeders are not permitted in the common areas or areas outside of a residential lot.  One (1) bird house is permitted.  Multiple bird houses are prohibited.  Height may not exceed 6’.  No thistle bird seed feeders are permitted.

K.        Front Entry Decor

1.   Seasonal decor, such as wreaths, are permissible on the front entry door and at each garage side light. Removal shall comply with established dates. Décor may not prohibit view of address from street.

VII.     PROHIBITED STRUCTURES ITEMS

Pursuant to the Declaration and/or these Design Guidelines, the following structures shall be prohibited from use in Grand Dominion by Del Webb:

~          Stand alone flagpoles
~          Storage buildings or sheds
~          Clothes lines or clothes poles
~          Stand-alone garages and secondary garages accessible by side or rear yards
~          Tents of a permanent nature, including screened in pergolas
~          Permanent Swimming pools
~          Spas or Jacuzzis
~          Fencing of any kind unless constructed by Del Webb or HOA
~          A bird feeder exceeding the roof eave in height
~          A squirrel house
~          Artificial vegetation including synthetic turf
~          Accessory buildings, including gazebos, greenhouses, sheds and guest houses, pergolas or freestanding structures unless constructed by Del Webb
~          Permanent children’s play equipment
~          Horseshoe pits unless constructed by Del Webb or HOA
~          Plastic or other bed edging / fencing (except along concrete surfaces)
~          Open fire pit
~          Mailbox Decor or Coverings
~          Thistle bird seed feeders
~          Rubber Mulch


All intended structures must receive written approval by the Modifications Committee before installation will be permitted.

Notwithstanding the above, Developer shall be allowed to install any structure(s) necessary for purposes connected with the development of Grand Dominion by Del Webb and/or as may be described in the Declaration within the development period. If above structures are not specifically addressed in the proceeding guideline text the structures do remain prohibited.

VIII.    IMPROVEMENTS OUTSIDE PRIVATE AREA

All improvements both inside & outside the private area require approval from the Modifications Committee.  The committee reserves the right to limit size, materials and location of all desired improvements.

A.        Pavers and Ribbons

Walking area(s) adjacent to the driveway which extends the overall driveway width not more than two feet (2’) per side are permitted.  provided the additional walking areas do not extend past the overall width of the outside wall of the garage, are attached to the driveway, and do not alter drainage.

1.   Ribbons may be installed from the garage to the public sidewalk or if desired may extend to the street curb.

a.       Homeowner is responsible for any aftermarket improvements and all repairs, replacements and financial expense.
b.      Pavers utilized for ribbons will require a brochure, color and drawing submittal indicating the color choice for the Modifications Committee.
c.       Plat of survey required

            B.        Front Entry Walkways, Stoops or Porch       
           
1.   The existing concrete walkway from the driveway to the front step or stoop may be removed if desired to provide continuity of a driveway ribbon utilizing pavers. Paver walkway width shall conform to the existing concrete walk.

2.   The concrete stoop or porch may be clad with pavers to match the new paver sidewalk if adequate vertical rise is available at the front door threshold. The stoop rise shall also be clad with matching pavers.

3.   Edging is permitted only along mulch bed and front entry concrete surfaces. It must be solid plastic and no more than 2” above the concrete surface to reduce mulch run off.

            C.        Walkways – Side and Rear

1.   Walkways to the rear of the home are permitted on some lots provided that set back lines or drainage slopes are not impeded. If a walkway is permitted, by prior approval only, no grass shall be planted between the house foundation and walkway. This area must be mulched. The walkway must be constructed of a continuous hard concrete or paver brick surface.  The walkway should be a minimum of twelve inches (12”) from the foundation and a maximum of thirty inches (30”) of sidewalk. There must be a minimum of ten feet (10’) between the walkway and the lot line.

2.   Paver utilization for walkways requires a brochure submittal with type and color choice of the pavers and design layout.

D.        Irrigation Systems

1.      The location of all sprinkler heads must be located on the Plat of Survey or independent drawing for Modifications Committee approval. The location of pertinent valves and controls must be noted.

2.      Sprinkler heads are not permitted in the parkway areas per the Village of Mundelein.

3.      Sprinkler heads along the side of the home shall be installed along the existing mulch beds and may not interfere with the natural swale and drainage.

4.      Owners shall not irrigate the wetland areas beyond residential boundaries.

5.      Association is not responsible for any damage caused to the irrigation system.

6.      The Village of Mundelein requires an annual inspection of irrigation systems.  Fees for inspection remain an obligation of the homeowner.

7.      All turf and landscape bed areas disturbed during installation of the underground irrigation system is responsibility of installer and individual
homeowner to restore to its original condition.

8.   All lines must be buried a minimum of 6”.

9.   Owner is responsible to ensure irrigation heads are flagged prior to community association turf aeration.



IX.       EQUIPMENT STORAGE

            To maintain an attractive community all equipment as follows shall be stored in the garage after usage.

            A.        Trash Containers

1.   All trash containers shall be covered containers and shall be stored in the garage of each unit.  Trash containers may be left out for collection at dusk on the day prior to collection and must be re-stored by dusk on the day of collection, weather permitting.
2.   Recommended to place address on number stickers attached on containers

B.         Lawn Equipment

1.      Swing sets and other non-portable play sets (including horseshoe pits) are not permitted.  All portable play equipment (including portable swimming pools), garden equipment (excluding hoses within containers), and lawn furniture must be stored nightly within the Private Area and shall not be left on other portions of the lot so as to impede mowing or maintenance activities.

2.   Lawn watering hoses shall be neatly kept in mulch beds, in a container, or on a hose reel at all times.  Such containers must be located within the rear or side yard mulch bed, on patio or deck in an area not to interfere with landscape maintenance.

3.   Hoses must be removed from spigots by November 15th for the winter season.
           
           C.         Sports Equipment
1. Watercraft, snowmobiles, etc. shall not be stored on any portion of the    residential lot


            C.        Commercial Vehicles

1.   No commercial vehicle, recreational vehicle, motorcycles, snow mobile, or other motorized vehicle and no boat, trailer, hitch or other similar personal property shall at any time be parked or stored on any portion of the Properties other than on a driveway or in a garage.  Unless otherwise specifically permitted by the Board or pursuant to rules and regulations adopted by the Board, driveways on the Properties may only be used to park commercial vehicles, recreational vehicles, snow mobiles, boats, trailers, or other similar vehicles for not more than twenty-four (24) hours total during any seven (7) day period at a time.
2. Regardless of vehicle plates, no vehicle with advertising is permitted other than in a garage.

D.        Seasonal Items

1.      Seasonal gardening supplies and tools are not to be stored on porches, patios or decks when not in season.  Items should be stored within the garage unless concealed in a storage box must be stored in the garage unless concealed in a storage box.

2.   Patio chairs, tables and grills may be left in place on a patio or deck when not in use, or not in season.

E.         Storage Containers

1.      Portable on Demand storage units are permitted in the event of moving in or out of a home for a period not to exceed fourteen (14) days.
A

sit on sheets of plywood to eliminate damage to the driveway.  Any extension must be approved by the Association.

2.      Any and all damage to the driveway is the sole responsibility of the homeowner.

3.      Storage containers may not be left on street.
           
F.         Construction Dumpsters

1.   Construction Dumpsters are permitted in the event of a large remodeling project inside the home for a period not to exceed fourteen (14) days.  The dumpster shall sit on a sheets of plywood to eliminate any damage to the driveway.  Any extension must be approved by the Association.

X.        RESIDENCE MODIFICATIONS

            A.        Storm Doors

1.      All storm door additions must be full glass or full glass self-store and shall be must match the color of the front door, or be white. If anything other than a white frame storm door is requested, an application must be submitted. If anything other than white with clear glass is selected, a photograph of the front of the home must be submitted with the application form. Security doors are prohibited.  A brochure with a picture of the selected door type and color is required for approval by the Modifications Committee, with the application.

            B.        Entrance Doors and Sidelights – Glass Inserts

1.   Glass inserts for front entrance doors are permitted based upon prior approval. Leaded or etched inserts are acceptable. No colored glass is permitted.  A brochure with a picture of the selected design must be submitted with your application.

            C.        Shutters

Shutters are permitted as long as they are consistent with the model plan in material and color. Brick elevation models must use flush face shutters only. Homes with siding elevations must use louver style shutters only. Front elevation determines shutter type for entire home.
                                               
            D.        Garage Door Window Inserts

1.      Clear glass garage door inserts for the upper panel are permitted based upon prior approval.  No colored glass is permitted.

2.      A brochure noting the desired window design is required for approval.

            E.         Garage Pedestrian Doors/Window Additions

1.   Garage pedestrian doors or window additions shall be permitted and plans must be submitted to the Modifications Committee. Type, size, styles must conform to original existing styles and construction.

            F.         Awnings

1.      Awnings are permitted on the rear and sides of the residence only.

2.      No logos or advertising are permitted on awnings.

3.      Approved awning colors will be those that are solid color and must be consistent with siding or trim.   A fabric “swatch” must be submitted with the application for approval.

G.        Solar Tubes and Fireplace Vents
& Solar Panels

1.      Roof mounted solar tubes, solar panels and fireplace vents are permitted, however the enhancement may void applicable warranty from Del Webb.
2.      The approval submittal must show location and height above roof along with the diameter.
3.      Any fireplace vent that exceeds a thirteen (13”) inch diameter must be boxed and sided. The Modifications Committee will consider side vents.

H.        Flag Mount

1.      Stand-alone flagpoles are not allowed on residential lots in Grand Dominion by Del Webb.  One (1) flag mount
on the front of the home
can be affixed to framing on either side of the garage door or to framing at the approach to the front entry door.
One (1) flag
mount may be affixed to framing on the rear of the home.  No part of the flag can project four (4’) feet beyond the eave. Flag mount location requires approval.

2.      Only one (1) flag is allowed including small garden flag in front of the house.

I.          Satellite Dishes and Antennas

1.      Roof mount dishes are not permitted except on a variance if inadequate reception is received on a wall mount. Roof mounts and or wall mounts may void applicable warranties from Del Webb.  Roof mount dishes should be no larger than one meter in diameter, and must be a neutral color.  It should not be visible from the street.

2.      Pole mounted dishes must be mounted on pole under 4’ high, in existing mulch bed. 

3.      Wiring must be concealed.

4.      No wires can run along roof.

5.      Wire running along siding must be painted to match.

6.      We recommend an application be submitted to the Modifications Committee prior to installation.  An application is required to be submitted within ten (10) days of installation. is required, and The Modifications Committee reserves the right to demand changes necessary to meet requirements.

J.          Sound Equipment

1.   Any exterior sound emitting devices (speakers, sound players, insect/animal repellers, chimes, etc.) shall not create an audible nuisance to your neighbors. 

K.        Surveillance Equipment

1. The installation of video cameras/surveillance equipment and/or motion lights is considered an alteration of the exterior of the buildings that will require written approval of the Modifications Committee before installation. Installation approval of video camera, surveillance equipment and motion lights will only be given upon consideration of its affect on neighbors’ right to privacy and quiet use and enjoyment of their property. Installations will not be permitted that the committee determines will cause an unreasonable interference with neighboring residents’ reasonable expectation of privacy. Whenever possible the cameras and lights shall be placed in the least intrusive or visible location. Applications for installation of camera and lights are to include a Plat Plan showing the location of cameras and lights in relation to neighboring structures; specify size, shape, angle of view and include a photograph and or drawing of the camera(s) and lights prepared by the manufacturer.  Neighbors shall be notified in writing of owner’s intent to install such equipment prior to filing of an application to the Modifications Committee and prior to any installation.  The Modifications Committee will hear any objections to such application when considering the application.

L.         Lighting

1.      Low-voltage solar and decorative lighting are allowed only within the Private Area.

2.      Building or deck-mounted light fixtures, including spotlights, floodlights, lantern lights and stair lights shall conform to the architecture of the home.

3.      Post-mounted light fixtures shall not exceed a height of six feet (6’) from finished grade.  Post-mounted light fixtures shall conform to the architectural character of the home.

4.      Bollard light fixtures shall not exceed a height of forty-eight inches (48”) from finished grade.  Bollard light fixtures shall conform to the architectural character of the home.

5.      All lighting installed on lots should be low level and recessed to shield the source of the light.  Low voltage fixtures shall be located and aimed carefully. Tree mounted down lights are not allowed, however, up lights to highlight trees are permissible.

6.      A lighting layout plan for low voltage fixtures shall be submitted to the Modifications Committee for review and approval.  The submittal shall include a plan of existing landscaping and hard surface locations, proposed light fixture locations, and manufacturer and light type.

7.      Low voltage or solar lights may be utilized to wash the main façade of the residence.

8.      Low voltage light fixtures may not exceed eighteen inches (18”) in height and spaced a minimum of eighteen inches (18”) apart.

9.      Enclosures of light fixtures shall be designed to conceal the lamp bulb. 

10.  No lighting shall be permitted that constitutes a nuisance or hazard to any homeowner or neighboring resident.  Light bulbs may not exceed the manufacturer’s recommendation for bulb wattage.  Lights may not interfere with neighbors’ privacy.  A light shining into a neighbor’s window would constitute such interference, and may not be installed without such neighbor’s consent.

11.  Homeowners may not install security spotlights or floodlights unless activated by a motion detector.

12.  Colored lamps are not allowed, other than seasonal.

13.  Junction boxes and other lighting hardware shall be placed below grade or screened by landscape material to minimize daytime visibility.

14.  Seasonal lighting is permitted for illumination during a thirty (30) day period prior to and thirty (30) day period after the any holiday season.  Should extreme weather conditions become a factor in removal of seasonal lights within the designated time frame, the Modifications Committee, in their sole discretion, may grant an extension of the allowable period of removal. Seasonal lighting and electrical cords shall be located so as to respect driveway snowplowing operations and sidewalk snow removal operations.  Electrical Ccords shall never be located over public on sidewalks. Inflatable decorations are not permitted.

15.  Attaching lighting to your home may void applicable warranties from Del Webb.

16.  Lighting which interferes with natural wetland wildlife is prohibited.

M.        Gutters, Downspouts and Extensions

1.      Gutters and downspouts shall match those originally installed in color and composition.

2.      Gutters, Downspouts, Extensions – gutters may be buried with turf pop-ups or grated covers.  Pipes must be buried a minimum of

”.  Elbow attachments may be used as long as they do not run along a sidewalk, front stoop, and driveway or interfere with landscape maintenance or snow removal operations.

3.      Village of Mundelein permit required for buried downspout extensions.
4.      Grate covers are to be used however no rather than pop ups. should be used. Installation must be installed at grade level.

XI.       SIGNAGE

            A.        “For Sale” or “Rent”

1.      To minimize the esthetic impact only one (1) sign will be permitted on any individual lot.

a.   No more than one (1) “For Sale” sign will be permitted on any individual lot within the Community.  Such sign shall be located wholly within the lot being advertised “for sale.”  The sign shall be of conforming size and design provided by the Association.  The overall height from finished grade at the spot of the sign may not exceed six feet (6’). The sign must be removed within two (2) working days following the closing of the property, or the termination of the listing agreement.
b.   “Open House” directional signs, which provide directions to a house, which is for sale or for lease to which the public is invited for a walk-in inspection, are not permitted ARE NOT PERMITTED.
c.   No more than one (1) “For Rent” sign is permitted in a window only.  No “For Rent” yard signs permitted.  Size may not exceed 18” x 24”.
d.   “Political signs” – no more than one (1) is permitted during an election cycle in accordance with village ordinance.  Size may not exceed 18” x 24”.

            B.        No Soliciting

1.      “No Soliciting” and security/alarm notifications shall be limited to place cards or stickers not to exceed five by seven inches (5” x 7”) in size placed on the front door or doorframe or in a window near the front door or no more than five (5’) feet within the mulch bed closest to the front door of the residence (i.e. not garage or garage door)

2.      Contractors retained by homeowners are not permitted to place the corporate signage on any part of the homeowners’ lot or within the association’s common areas.

3.      In accordance with the Declaration, no other signs are permitted on any residential lot.

C.        Disclaimer

1.   Notwithstanding the above, Developer shall be allowed to install any sign(s) necessary for purposes connected with the development of Grand Dominion by Del Webb and/or as may be described in the Declaration.

If any structures are not specifically addressed in the preceding guideline text the items do remain prohibited.

XII.     COMMUNITY ASSOCIATION COMMON AREA AND RECREATIONAL FACILITY DESIGN GUIDELINES

The following Design Guidelines govern the maintenance and operation of the Common Area (including Limited Common Area), Neighborhood Facilities, and Recreational Facilities, including the Recreation Center. 

A.        Architectural Character

1.   The physical structures constructed by Del Webb and conveyed to the Community Association shall be maintained and/or replaced by the Community Association utilizing the same or similar design, size, location, style, structure, materials, color and architecture.

B.        Landscaping

1.   The Community Association shall be responsible for the maintenance of the landscape corridors, medians, and other common area. The Community Association shall maintain the landscaping required to be maintained by the Community Association under any Supplemental Declaration which may be adopted by the Board of Directors of the Community Association creating a Limited Common Area Expense or Neighborhood Expense without materially changing from the original design. 

2.   All Common Area at build-out, where not built upon or paved (and unless included in a wetland or other natural preserve area) will be maintained.  Landscaping maintenance shall extend to the back of the curb on all adjacent street sides of the site.

3.   The minimum density of plant material shall depend upon the size of the site and the extent of the landscaped area.  There shall be an appropriate amount of specimen sized trees (at maturity) and shrubs.  Ground shall be covered with a combination of inert and living materials.  Inert materials shall include the materials described in Appendix “D” of these Design Guidelines.

4.   All areas paved for pedestrian traffic such as walkways, plazas, and courts shall be a hard surface material with limited vertical irregularities.

5.   The plantings allowed in Grand Dominion by Del Webb were selected after consideration of several factors.  A list of the prohibited plantings is set forth in Appendix “E”.

6.   All landscaping shall be designed and maintained so as not to interfere with the view of any ground signs on the site or adjacent properties, and not obstruct the view of traffic entering, exiting, or passing by the site.

7.   Where landscaping of a new project adjoins an existing landscaped area, the new landscaping shall include appropriate transition between the two areas.

C.        Temporary Facilities

During the development period, temporary buildings shall be allowed to be placed on Common Areas by the Developer or the Community Association.  Such uses shall be for marketing the project by Del Webb, temporary buildings during construction by Del Webb, and temporary buildings used for Community Association purposes. 

XIII.    ARCHITECTURAL REVIEW AND RESIDENTIAL PROPERTY OWNER REQUIREMENTS

The architectural review process has been established to maintain the integrity of the architectural and design character of Grand Dominion by Del Webb.  To this end, the Modifications Committee will review all proposed additions, improvements or alterations on homes for conformity with the Design Guidelines.  Article IX of the Declaration sets forth provisions with respect to the review process, including possible delegation of certain review functions to the Modifications Committee and ultimate transfer of the review function to that committee at the end of the Development Period.  Until such transfer, any and all approval or denial rights rest with Del Webb and each such approval or denial will be in writing.  In the event certain review functions are delegated to the Modifications Committee, Del Webb reserves the right during the Development Period to withhold approval even if granted by the Modifications Committee.

A.        Residential Property Owners

Homeowners are required to submit plans (described below) to, and receive written approval from the Modifications Committee prior to performing (1) additions, alterations, or modifications to existing homes, (2) exterior painting, (3) exterior landscaping, (4) walls, (5) any exception to or deviation from the Design Guidelines, or (6) any concrete work, ancillary equipment, signage, and any and all other such on-site improvements not listed in the Design Guidelines.  However, it shall be the responsibility of all homeowners to comply with all standards and guidelines of Article II of these Design Guidelines, as well as all requirements of the Declaration.

B.        Submittals For Changes and Additions

                  The procedures for requesting architectural changes are as follows:

1.      Obtain the “Application for Changes and Certification Design Guidelines Compliance” Architectural Modification Application form available at:

a.       Lakeside Lodge front desk
b.      www.ourgranddominion.net  Community Home – Community documents

2.      The application shall include the following information:

a.       Owner’s name, address and telephone number.
b.      The neighborhood and street address of the lot.
c.       The Builder’s original plans number and/or model name of home.
c. The nature of the request.  Such requests shall be limited to:

1)      A brief description of the proposed construction or modification.
2)      Planned completion date for the construction or modification proposed in the Review Request.
3)      An acknowledgment that the owner is responsible for scheduling all work in a timely manner and for complying with any approval issues by the Modifications Committee.
4)      The name, address and telephone number of owner’s agent, representative or subcontractor (if applicable).
5)      The specific plans or information required by the request being made.
6)     
All Final elevation

e.       The entire process of submission, review and communicated decision back to the homeowner takes a minimum of one (1) week, but will not exceed four (4) weeks.
f.       The request approval is good for six (6) months.
g.      The main reason requests are denied is lack of information.
h.      The Modifications Committee is not responsible for ensuring the structural integrity or soundness of approved construction or modification, or for ensuring compliance with building codes and other governmental requirements.
i.        The decisions and deliberations of the Modifications Committee are confidential.  The committee is made up of volunteers so please be courteous and respectful.  Don’t call members at home to ask if an application has been approved.  Contact the management office if you have not heard by Thursday Wednesday evening following the weekly meeting.
j.        It is the responsibility of the owner to obtain all necessary permits and approvals for the city before beginning work on a project.  There may be required governmental inspection required. 
k.      It is highly recommended required that before you start digging on your property (for deck building, fencing, landscaping, etc.) Illinois State Law requires that you call JULIE (Joint Utility Locating Information Excavators) 1-800-892-0123.
l.        Existing approvals do not set precedent for future applications.  All applications will be reviewed considering the current guidelines and specific location of the dwelling with respect to neighborhood area and surroundings.  Interpretation, application and enforcement of Design Guidelines may and will from time to time be amended.

5.   Variance – The reviewing body may Declarant must  authorize variances in writing from its guidelines and procedures but only: (a) in accordance with duly adopted rules and regulations, (b) when unique circumstances dictate, such as unusual topography, natural obstructions, hardship, aesthetic or environmental consideration, (c) to accommodate any ADA or disability needs.  Inability to obtain or the terms of any government approval or the terms of any financing shall not be considered a hardship warranting a variance.

6.   Upon completion of review by Modifications Committee, one (1) set of plans shall be returned to the homeowner and a copy of the Modifications Committee’s decision and shall be rendered in one (1) of the three following forms:

a.   “Approved “Final Approval as requested” – the entire document is approved in total.
b.   Approved as Noted “Final Approval subject to the following conditions/modifications”– the document is partially approved.  A homeowner may proceed with the work to be performed as modified, but must comply with any and all notations on the submittal.
c.   “Not Approved “Disapproved for the following reasons” – The entire document submitted is not approved and no work may commence.




C.        The guideline in effect at the time of submission

is
the controlling document.  Approvals under earlier versions of the Design Guidelines are considered Grandfatheredin.


D
.        Fees

Review of all applications and all landscaping plans may be subject to a minimal fee structure payable to Grand Dominion to cover costs.  Deposits may be required on all construction projects.  Full deposit refunds will be returned once inspection has been performed to verify area is cleaned and restored to original and to ensure contractor has not dumped on site.

           
E
.         Effect of Building Permit

If the plans submitted by a homeowner require a building permit, the approval by the Modifications Committee is not a guarantee that such plans will be approved by the Village of Mundelein.  If the Village of Mundelein requires modification to such plans, such modifications must be appended to the applications submitted to the Modifications Committee for the homeowner to remain in compliance with those guidelines.


XIV.    NON-LIABILITY FOR APPROVAL OF PLANS

Article IX, Section 9.7 of the Declaration contains a disclaimer by Del Webb, the Community Association, and the Modifications Committee of liability or responsibility for the approval of plans and specifications contained in any request by a homeowner.  PRIOR TO SUBMITTING PLANS OR INFORMATION FOR REVIEW, YOU SHOULD READ AND UNDERSTAND THIS DISCLAIMER.  IF YOU DO NOT UNDERSTAND IT, PLEASE ASK A REPRESENTATIVE OF THE ASSOCIATION OR THE MODIFICATIONS COMMITTEE TO EXPLAIN IT.

XV.     ENFORCEMENT OF INSTRUMENTS

Article IX of the Declaration describes scope of authority of the Community Association, including the review and determination of alleged violations by homeowners and Residents, execution of certain remedies, and recommendations to the Board of Directors of the Community Association for further action.  Del Webb or the Community Association may execute certain remedies as provided for in Article IX of the Declaration.

A.        Non-compliance by Homeowner

Article IX, Section 9.8 of the Declaration describes the Community Association’s right to require the homeowner to remedy any non-compliance.  After notice of the violation, the Homeowner shall have thirty (30) days to complete the remedy.  If the remedy cannot be performed within thirty (30) days, the Community Association shall take the time estimated for taking the remedial action into consideration.  If homeowner has not complied within thirty (30) days, or the time period otherwise designated by the Community Association if applicable, Del Webb or a duly authorized representative of the Community Association shall have the right to enter the home lot to perform the necessary work to bring the home into compliance.  All costs incurred by Del Webb or the Association to bring the noncompliant homeowner into compliance, including the cost of the work and interest, shall be charged to the homeowner as a Benefited Assessment. Any amounts invoiced to the homeowner pursuant to this paragraph or pursuant to the Declaration as Benefited Assessments shall be due and payable within thirty (30) days of receipt of such invoice by homeowner.  The failure of the homeowner to pay a Benefited Assessment levied against homeowner is a default and could subject homeowner to suspension of his voting rights and rights to use the Common Area(s) and the Recreation Center and such additional remedies as provided in the Declaration.  The decision to suspend a homeowner/member’s rights to use such facilities will be made by the Board of Directors of the Community Association.

B.        Appeal of Decision

Any homeowner, lessee, or other resident aggrieved by a decision of the Modifications Committee may appeal such decision.  An appeal shall be considered only if the appellant has modified the requested action or has new information that would, in the Community Association's opinion, warrant reconsideration.

XVI.    CHANGES AND AMENDMENTS TO THE DESIGN GUIDELINES

The Design Guidelines may be amended as follows:

A.        Changes to these Design Guidelines may be proposed by the Board of Directors of the Community Association and/or the Modifications Committee.  Additionally, any homeowner may submit to the Board of Directors proposed changes to these Design Guidelines for review and consideration.

B.        Any Modifications Committee recommendation to amend the Design Guidelines shall be approved by two-thirds (2/3rds) of the Committee members and be forwarded to the Board of Directors for consideration.

C.        If the Board of Directors approves the proposed amendment, it shall become an amendment to the Design Guidelines.  Such amendment shall be promptly posted at all Recreational Facilities bulletin boards and copies made available at the Community Association office.

D.        All amendments shall become effective upon adoption by the Board of Directors.  Such amendments shall not be retroactive to previous work or approved work in progress within a 6 month approval period.

E.         In no way shall any amendment to the Grand Dominion by Del Webb Design Guidelines change, alter or modify any provision of the Declaration, any Supplemental Declaration or the Articles or Bylaws of the Community Association.

F.         Anything to the contrary in Paragraphs A through E notwithstanding, the Design Guidelines may be amended by the Declarant at any time during the Development Period without consent or approval of the Modifications Committee or Board of Directors of the Association.

XVII.  DECLARANT'S IMPROVEMENTS

As part of the planning and development of Grand Dominion by Del Webb, Del Webb has prepared a development plan and provided certain architectural designs, color palettes, landscaping design packages, parks, streets, model home packages, a sales pavilion, and recreation center. Market conditions, styles, marketing strategies, or other factors may cause Del Webb to change the type of models, size of homes, location of future amenities or streets, color palette of homes, landscaping styles or plant materials, construction methods or materials or the landscaping on the Common Area.  Notwithstanding the current provisions of these Design Guidelines, the terms of the Design Guidelines may be amended in the future by the Board of Directors.

XVIII. AUTHORIZATIONS

These Design Guidelines have been prepared by Pulte Home Corporation, a Michigan corporation, for use at Grand Dominion by Del Webb.

These Design Guidelines are to be adopted by the Board of Directors of the Grand Dominion by Del Webb Community Association.  These Design Guidelines may be amended from time to time by the Board of Directors.  During the Declarant Control Period, Del Webb will provide leadership of the Community Association Board and will control amendments and revisions to these Design Guidelines.













APPENDIX A

                                                        BUILDING SETBACKS

A.        RESIDENTIAL AREAS

The building setbacks described below are applicable to single-family homes in Grand Dominion by Del Webb and recognized by the Modifications Committee.  Notwithstanding any other provision of law, all building setbacks must meet these requirements, except for such buildings which are built by Del Webb pursuant to approvals obtained from the Village of Mundelein.  The building setback requirements generally define the Private Area, except as noted in Section II.B.1 of the Design Guidelines:

The non-residential areas of Grand Dominion by Del Webb will be Common Area, Limited Common Area, Neighborhood Common Area, Entry Monuments, Del Webb Boulevard Pavers and Walls, Del Webb Boulevard Islands, Connector Street, Irrigation Lines, Retaining Walls, Wetlands and Wetland Buffers and all water service facilities included in the common area as defined in the Declaration.  Additionally, the sales center, recreation center, parks, and other uses will have various building setback requirements.  These requirements are outlined in the Annexation Agreement between the Village of Mundelein and Pulte Homes Corporation, as may be amended from time to time.

APPENDIX D

APPROVED INERT MATERIALS

Approved inert materials shall include those described below and other materials as may be approved by Del Webb from time to time.  Determination of whether a material is acceptable for inclusion in any specific situation shall be made by Del Webb and shall be in writing.  Currently approved materials are as follows:

A.        MULCH/BARK

Dark brown, hardwood shredded mulch may be approved as inert ground cover, except that compost may be used on perennial and annual planting beds.   At a minimum, mulch must be double processed.  We recommend triple processed mulch.  (See page 5, Section II (a).)

Stone mulch Decorative rock may only be used within a one foot (1”) radius four (4) square feet radius of a downspout, provided that it adheres to the following standards:

Minimum size: ¾” in diameter
Maximum size:      4” in diameter
Colors:                   Earth tone only (i.e. buff, beige, charcoal, red, brown or black)

B.        DECORATIVE ROCK MATERIAL

With the exception of above,  decorative rock shall not be permitted as ground cover. Categories of decorative boulders which may be approved within the Private Area are as follows:

 i)  Moss Rock;
ii)  Tan Limestone;
iii) Tan Sandstone;
iv)  Granite or;
v)   Fieldstone

Stone or boulders shall not be used as a bed-edging material.  Stones or boulders are not permitted in turf areas.  The Modifications Committee reserves the right to limit the number of decorative stones in the landscape.
